1. Who we are. The Lodgemark service and websites are operated by Lodgemark Data Ltd, registered in England and Wales, company number 17405388, registered office 11 Bell Lane, Lewes, East Sussex, BN7 1JU, United Kingdom ("Lodgemark", "we").
2. Membership. Membership is for properties, not individuals: your organisation holds the account and is responsible for its users. Applications are reviewed; we may decline or revoke membership to protect the integrity of the member community and its data. Base membership is free.
3. Acceptable use. Use the service for your own property's business purposes and lawfully. Don't misrepresent who you are or your property; don't submit figures you know to be false; don't attempt to access other members' data or undermine the service's security; don't resell or scrape the service.
4. Your data and our licence (the covenant, in contract form). You own the data you submit. You grant Lodgemark a licence to host and process it solely to: provide the service to you; produce protected peer comparisons under our disclosure rules (peer figures at n≥3; financial medians at n≥5 with no contributor above 40%); and create anonymised aggregates that cannot identify your property, which we may retain and use, including commercially. This licence ends for identifiable data when your data is deleted; it survives only for anonymised aggregates already created. We never sell, license or disclose data that identifies your property without your explicit consent (for example, the per-post sharing choice on Initiatives).
5. Accuracy and evidence. The service is built on self-reported, evidence-backed figures. You're responsible for the accuracy of what you submit. AI features suggest, and you confirm; confirmed figures are yours.
6. The badge. The Reporting badge states only that your property reports with evidence, and its status (current/lapsed) updates automatically. Use it only on properties that hold membership; don't alter it or present it as implying verification, an award, or a score.
7. Verification (paid). Independent verification is an optional paid engagement under a separate quote. Verified status, certificates and registry entries relate only to the periods and figures actually reviewed.
8. Availability and changes. We aim to keep the service available and honest about problems, but it's provided "as is" — we don't promise uninterrupted or error-free operation. Free things don't become paid; paid things are new things.
9. Liability. Nothing limits liability for fraud, personal injury caused by negligence, or anything that can't lawfully be limited. Otherwise, for free membership our total liability is limited to £100; for paid services, to the fees paid for the engagement concerned in the preceding 12 months. Neither party is liable for indirect or consequential loss.
10. Closing your account. Close any time from your settings. Badge and public surfaces end immediately; a 30-day reopen window applies; then deletion per the Privacy Policy. We may close accounts for material breach uncured after notice, or extended non-use, with the same deletion path.
11. Governing law. These terms are governed by the law of England and Wales, and disputes go to its courts (non-exclusively).
